Terms and Conditions
The bidders(s) and the Auctioneer(s) agree that the terms listed below shall govern each and every auction sale.
All registration information the Bidder provides to the Auctioneer shall be current, complete, and accurate. All bidders must be 18 years of age or older. The bidder agrees to not use any device, software or routine to interfere or attempt to interfere with the proper working of any transaction being conducted on and during any auction sale.
1. Photos with lot descriptions are to be used to act as part of the item description. We make all efforts to note any defects prior to the auction close. Please view all photos for each item before you bid and bid accordingly.
2. Settlement for payment for purchases can be made by cash, interac/debit, Visa or Mastercard. All sales are subject to 13% HST (Harmonized Sales Tax). All sales are subject to a 10% Buyer’s Premium of the Purchase Price and payable by the Buyers. Full settlement to be made at the conclusion of the sale. Nothing is removed until paid in full, and invoice received.
3. Buyer acknowledges and agrees not to retract their bids. The Highest Bidder shall be the Buyer, and if any dispute arises during the Sale, then the Auctioneer, may at his discretion, put the Lot up again. The Auctioneer’s decision is final. The Auctioneer reserves the right to accept or reject any bid and shall control the bidding at all times.
4. Buyer shall be responsible for making all arrangements for merchandise pick-up and /or removal per specific terms or conditions listed for auction. Please note that some removal times are short, be aware of removal times when you bid. Removal times will be posted – buyer must adhere to these times, no exceptions will be made. Buyer must provide all packing materials necessary to remove all items purchased. (ie: packing paper, boxes, packing tape, moving dolley, additional help need to move items, etc as the Auctioneer does not provide any of these items).
5. The items have been displayed and each Buyer shall be held to have satisfied himself as to the condition, identity and authenticity, and shall not be permitted to make any objections after the sale on any grounds whatsoever. Neither the Auctioneer nor the Owner is responsible for any error on conditions of items.
6. All items are sold “AS IS, WHERE IS”. Once the item is sold, the Buyer shall assume full risk and responsibility for the item.
7. Despite efforts to avoid withdrawal of item/lots from the sale after they are listed it may sometimes be necessary. Auctioneer and the Owner/Seller reserve the right to do so at any time before or during the sale. The Owner/Sellers of property sold through this Site reserve the right to reject any and all bids in their sole discretion. If there is a reserve on a lot, the Auctioneer and/or the Seller have the right to bid on behalf of the Seller.
8. Merchandise becomes the full responsibility of the Buyer at time of PAYMENT. Any Buyer having someone, other than himself, pick-up his purchases must notify the Auctioneer. Buyer shall be at his own risk and liability at the Owners’ property for pick ups, and shall hold the Owner/Seller and the Auctioneer harmless for the Buyer’s negligence. Buyer shall also be held responsible for any damage to the Owner’s property, caused by the Buyer. After final removal date, unless previous arrangements have been made, there will be a per day, per item/lot storage fee charged to the Buyer. Buyer’s that fail to pick up their items shall be billed for disposal fees of mininum $10.00CAD per lot.
9. Auctioneer reserves the right to resell any property not paid for in full with all funds received by Auctioneer within two days on the online auction item/lots closing date. Failure to pay for item/lots won on this online auction may result in legal action against Buyer.
10. Auctioneer cannot , and will not, be held responsible for any interruption in service, errors and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. The Auctioneer, in its sole discretion, may void a sale, temporarily suspend bidding and re-sell any items/lots that were affected by any malfunction. The decision of the Auctioneer is final.
11. Auctioneer gathers information about Bidders and Owners/Sellers for the purposes of conducting online auctions only. Auctioneer does not, and will not, sell or rent this information.
12. Auctioneer uses email mailing lists to notify its customers about online and live auctions. If you are receiving a particular mailing and wish to discontinue receiving future mailings, simply forward the received email to Auctioneer to have your name removed from our list.
13. As a Bidder you are responsible for any bids placed under your bidding number and password. The security of your Bidder information is your sole responsibility as you, the Bidder, will be responsible for any and all bids placed under your number. If at any time you feel that your Bidder number and password have been compromised due to lack of security on your part you must notify Auctioneer immediately.
14. By using this site, you, the Bidder, agree in advance to accept all rules, terms, and conditions, and any such possible changes thereto.

16. What does “SOFT CLOSE” mean? Items close every second. Any bids placed in the last minute of the auction will cause the auction item to stay open for an additional 3 minutes. This will continue until all bidding has ceased.
17. What is “MAXIMUM BIDDING”? Bidders may place a maximum bid on each item. Your initial bid will increase automatically, each time you are outbid, up to your maximum bid. If a competing bid is above your maximum bid, you will be required to bid online again, if you want to be the successful bidder.
18. Any items purchased and not picked up within 30 days will be considered deemed and abandoned and will be disposed of at the Auctioneers discretion.
19. Auctioneer has set pick up times. No exceptions. Furthermore, regardless of circumstances, limitations or lack of pick up for any reason resulting in the buyer not receiving paid for items is not, nor will it be the responsibility of A Touch of Class.
20. When picking up your items, please check and review your statement at that time. It is the customers responsibility to check and ensure that they have all items paid for. A Touch of Class is not liable for any misplaced or unpacked/not taken items.

STRATEGY: We recommend that ALL BIDDERS put in their maximum bid when placing a bid online. This does not mean you will have to pay the amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment.

Online Vehicle Auction Bidding Closes Aug 4, 2015

All Vehicles are Subject to Seller Approval. Winning Bidders will be notified by phone or email on Tuesday, August 4th after auction closes.

There is a buyers premium on each vehicle, the buyers premium is listed in the details of each vehicle, either 10% Buyers Fee (min $125) or Regular Buyers Fee as follows:

$1.00 – $399.99 = $160
$400 – $999.99 = $185
$1000 – $1999.99 = $240
$2000 – $2999.99 = $295
$3000 – $3999.99 = $320
$4000 – $4999.99 = $340
$5000 – $5999.99 = $370
$6000 – And up = $440

Winning Bidder is required to pay a deposit of $300 by Cash, Debit, Visa or Mastercard if bid approved. Balance must be paid by Cash or Certified Cheque.

HST will be added to the Purchase Price and Buyers Fee of each vehicle. Once paid in full, buyers will receive a paid in full receipt and bill of sale and ownership.

Terms and Conditions
The bidders(s) and the Auctioneer(s) agree that the terms listed below shall govern each and every auction sale. All registration information the Bidder provides to the Auctioneer shall be current, complete, and accurate. All bidders must be 18 years of age or older. The bidder agrees to not use any device, software or routine to interfere or attempt to interfere with the proper working of any transaction being conducted on and during any auction sale.

1.Photos with lot descriptions are to be used to act as part of the item description. We make all efforts to note any defects prior to the auction close. Please view all photos for each item before you bid and bid accordingly.

2.Settlement for payment for purchases will be made by Visa or MasterCard. All sales are subject to provincial sales taxes where applicable. HST provinces will be charged 13% on all purchases, buyer’s premium, convenience fees, and shipping and handling costs. British Columbia will be charged 12% on all fees and non-HST provinces with 5% on all fees and Quebec buyers will be charged GST on all fees. International bidders do not pay any additional taxes provided items are shipped out of Canada.

3.All sales are subject to a 10% Buyer’s Premium of the Purchase Price and payable by the Buyers. Full settlement to be made at the conclusion of the sale. Nothing is removed until paid in full, and invoice received. Buyer acknowledges and agrees not to retract their bids. The Highest Bidder shall be the Buyer, and if any dispute arises during the Sale, then the Auctioneer, may at his discretion, put the Lot up again. The Auctioneer’s decision is final. The Auctioneer reserves the right to accept or reject any bid and shall control the bidding at all times.

4.Buyers picking up their merchandise shall be responsible for making all arrangements for merchandise pick-up and / or removal per specific terms or conditions listed for auction. Please note that some removal times are short, be aware of removal times when you bid. Removal times will be posted – buyer must adhere to these times, no exceptions will be made. Buyer must provide all packing materials necessary to remove all items purchased.

5.Buyers whose merchandise will be shipped will be responsible for payment of the convenience fees and shipping fees. These fees will be charged to the credit card on file. Convenience fees; all items being shipped will be charged with a $10.00 convenience fee for the first item purchased and a fee of $2.00 for every additional item. This fee covers securing your purchase at the facility until shipped.

6.All items are sold “AS IS”. Condition reports available upon request.

7.Despite efforts to avoid withdrawal of item/lots from the sale after they are listed it may sometimes be necessary. Auctioneer and the Owner/Seller reserve the right to do so at any time before or during the sale. The Owner/Sellers of property sold through this Site reserve the right to reject any and all bids in their sole discretion. If there is a reserve on a lot, the Auctioneer and/or the Seller have the right to bid on behalf of the Seller.

8.Merchandise becomes the full responsibility of the Buyer at time of PAYMENT. Any Buyer having someone, other than himself, pick-up his purchases must notify the Auctioneer. Buyer shall be at his own risk and liability at the Owners’ property for pick ups, and shall hold the Owner/Seller and the Auctioneer harmless for the Buyer’s negligence. Buyer shall also be held responsible for any damage to the Owner’s property, caused by the Buyer.

9.Any items purchased and not picked up on pick up day will be shipped and all charges for shipping will be charged to your credit card.

10.Auctioneer reserves the right to resell any property not paid for in full with all funds received by Auctioneer within two days on the online auction item/lots closing date. Failure to pay for item/lots won on this online auction may result in legal action against Buyer.

11.Auctioneer cannot, and will not, be held responsible for any interruption in service, errors and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. The Auctioneer, in its sole discretion, may void a sale, temporarily suspend bidding and re-sell any items/lots that were affected by any malfunction. The decision of the Auctioneer is final.

12.Auctioneer gathers information about Bidders and Owners/Sellers for the purposes of conducting online auctions only. Auctioneer does not, and will not, sell or rent this information.

13.Auctioneer uses email mailing lists to notify its customers about online and live auctions. If you are receiving a particular mailing and wish to discontinue receiving future mailings, simply forward the received email to Auctioneer to have your name removed from our list.

14.As a Bidder you are responsible for any bids placed under your bidding number and password. The security of your Bidder information is your sole responsibility as you, the Bidder, will be responsible for any and all bids placed under your number. If at any time you feel that your Bidder number and password have been compromised due to lack of security on your part you must notify Auctioneer immediately.

15.By using this site, you, the Bidder, agree in advance to accept all rules, terms, and conditions, and any such possible changes thereto.

16.Theresa Taylor Auctioneering is acting as Agent for the Seller. All guarantees are between seller and the buyer. Disclaimer; due to the nature of the business of Pour une Soiree all manufacturer labels have been removed.

Both the Bidder and Maple City Auction Services (the Auctioneer) agree that the following Terms and Conditions shall govern each and every auction.
– YOU MUST REGISTER to bid. You must provide a valid credit card. Your card will NOT be charged, registration is free. You must be at least 18 years old to bid.
– A Buyer’s Premium of 13% will be added to your bid total, (a 3% discount will be given if invoice is settled by Cash or Debit), plus applicable taxes (13% HST).

All Vehicles are Subject to Seller Approval. Winning Bidders will be notified by phone or email on Wednesday, July 29th after auction closes.

There is a buyers premium on each vehicle, the buyers premium is listed in the details of each vehicle, either 10% Buyers Fee (min $125) or Regular Buyers Fee as follows:

$1.00 – $399.99 = $160
$400 – $999.99 = $185
$1000 – $1999.99 = $240
$2000 – $2999.99 = $295
$3000 – $3999.99 = $320
$4000 – $4999.99 = $340
$5000 – $5999.99 = $370
$6000 – And up = $440

Winning Bidder is required to pay a deposit of $300 by Cash, Debit, Visa or Mastercard if bid approved. Balance must be paid by Cash or Certified Cheque.

HST will be added to the Purchase Price and Buyers Fee of each vehicle. Once paid in full, buyers will receive a paid in full receipt and bill of sale and ownership.

When the auction closes, if you receive a message saying, “You may have won” on any particular item, This will be followed up an invoice.within a few hours.

10. Upon the fall of the auctioneer’s hammer, and/or when the Auctioneer says “sold”, title on the property shall pass to the highest bidder, who thereupon assumes full risk and responsibility. All property shall be removed from the premises by the purchaser at his own risk anil expense within the time period announced by the auctioneer and if not so removed, may be sent by Auctioneer to a storage facility, for the account, risk, and expense of the purchaser.
11. Auctioneer shall, as a courtesy, undertake to make execution bills for responsible parties in their absence, yet reserves the right to decline to do so, and in no case shall be responsible for failure to do so. Please leave payment in amount of bid with accompanying name and address. The difference between the sale price and the bill, or the whole payment, if the bid fails will be returned at once. Removal of merchandise shall be in accordance with other conditions listed herein.
12. Auctioneer reserves the right to withdraw any item before or during the sale.
13. Neither Auctioneer nor Consignor shall be liable for any personal injury on the premises where sale shall be held.
14. If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to Auctioneer and the Consignor by law, including, without limitation, the right to hold the purchaser liable for the bid price, the Auctioneer, at his option, may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) re-sell the property publicly or privately, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs, including storage, the expenses of both sales, Auctioneer commission at its regular rate and all other charges due hereunder, and incidental damages.
15. Removal – Removal shall be at the expense, liability, and risk of the purchaser. Purchases will he delivered only on the presentation of a paid bill. Auctioneer shall not be responsible for goods not removed within the time specified, and shall have the option of removing and storing at the expense and risk of the purchaser any article purchased, but not paid for and removed within the specified time. Non-delivery responsibility – Auctioneer shall not in any event, be liable for non-delivery or for any other matter or thing, to any purchaser of any lot, other than for the return to the purchaser or the deposit or sum paid on said lot, should the purchaser be entitled to it.

All Vehicles are Subject to Seller Approval. Winning Bidders will be notified by phone or email on Wednesday, July 22nd after auction closes.

There is a buyers premium on each vehicle, the buyers premium is listed in the details of each vehicle, either 10% Buyers Fee (min $125) or Regular Buyers Fee as follows:

$1.00 – $399.99 = $160
$400 – $999.99 = $185
$1000 – $1999.99 = $240
$2000 – $2999.99 = $295
$3000 – $3999.99 = $320
$4000 – $4999.99 = $340
$5000 – $5999.99 = $370
$6000 – And up = $440

We have a few rules that we all must follow to ensure that everyone has a safe and enjoyable auction experience. Greater Toronto Auctions (GTABid.com) is acting as an auctioneer-agent for many large and small companies and people just like yourself that are seeking to sell items they no longer need. Greater Toronto Auctions (GTABid.com) is not responsible for the actions of its consignors and/or their principals.

Greater Toronto Auctions (GTABid.com) in its sole discretion may ban from further use any buyer or seller which Greater Toronto Auctions (GTABid.com) believes to have in any way misrepresented itself or any items selling, failing to abide by terms, or conduct any improper auction behavior determined solely by Greater Toronto Auctions (GTABid.com).

PICKUPS & REMOVALS:

All purchases must be removed from the auction site without damaging any property and within the time announced or posted. All costs, responsibility and risk of such removal shall be done by buyer and, in every case; buyer will use prudence and care in such removal. If for any reason buyer fails to remove any of buyers purchases within the time specified, the auction company shall have the right but not the obligation, in its sole discretion, to remove and store such purchase at buyers sole risk and expense.

All items are sold in place. Buyers are responsible to remove items in a good workmanlike manner. Any plumbing must be shut off before being disconnected and any electrical that is disconnected must be capped. You must be bring any and all tools, equipment and labour required to disconnect and remove any items you purchase. We will only have security staff onsite that will not assist in any way with removal. Please plan ahead and come prepared, bringing the person-power and tools you may need. Any items not removed by the times shown will be deemed abanonded regardless of the price.

Unclaimed items, whether paid for or not, will be deemed to be abandoned at the close of the last pick-up date, unless the buyer has made previous arrangements with the auctioneer. A fee for special pick-up times outside of the posted pick-up time(s) will be added to the buyer’s invoice. After this time, abandoned items may be disposed of or re-sold at auction at the sole discretion of Greater Toronto Auctions. NO REFUND WILL BE PROVIDED FOR ABANDONED ITEMS AND PAYMENT MUST BE MADE FORTHWITH.

ABANDONED ITEMS – FEES:
Failure to pick up items at the posted times will result in your items being deemed abandoned. A $10 per item storage fee and a $25 per item moving charge will apply – large furniture items could incur additional moving fees to cover staffing and moving costs. This will be added to your invoice.

SALES TAX:

All bidders will be subject to HST.

Auction bidding starts to close Monday, July 20, 2015 at 12:00 p.m. (soft close in effect)

Preview – Wednesday July 15th ( 4 pm – 6 pm)

Removal: Monday July 20 (2 pm – 5 pm) and Tuesday July 21 (9 am – 12 Noon). All items must be removed by 12 pm on Tuesday July 21

Terms and Conditions – To bid and buy

REGISTRATION & IDENTIFICATION: At the time of registration, we collect information about you to verify who you are before you can bid. We collect credit card information to ensure that you are a qualified buyer. All bidders must be of legal age to bid.

PAYING FOR YOUR PURCHASES: There is no cost to register for an auction. Your credit card will not be charged unless you win. When an auction closes, all winning bidders will receive an e-mail with an attached invoice from AssociatedAuctioneers@mckenzieauction.com, immediatedly after the auction closes. All items must be paid for by 4 p.m. on Monday July 20, either in person at McKenzie’s 1881 Scanlan St. London.

REVIEWING YOUR BIDS: During an auction you can check the status of your bids at anytime. Note that no bids can be withdrawn after the auction for any reason. All items are sold as is, where is, with all faults.

BIDDING NOTIFICATIONS: You can choose to be notified by e-mail during the auction if you have been outbid. Please note that outbid notifications are NOT sent out during the last two hours of the sale.

PICKUPS & REMOVALS: The purchaser can pick up their items with a paid receipt. Items can not be picked up until the invoice is paid. All items must be removed by Tuesday July 21 @ 12 pm. Removal shall be at the expense, liability, and risk of the purchaser. We do not ship. Do not bid if you are unable to have your items picked up. Items are sold as is, where is, with all faults. Any item not picked up during the posted pickup times will be considered an abandoned item. If you abandon an item, your credit card will be charged for the purchase price of the item plus the cost to remove, transport and dispose the item.

CONDITIONS OF ITEMS SOLD & OUR ONLINE CATALOGUE: Our best efforts are made to represent all items accurately in descriptions and photographs; however, all items are ultimately sold on an ‘as is, where is’ basis, with all faults. We strongly encourage all bidders to personally verify the condition of each item during the scheduled preview times. All items sold As Is Where Is, No Warranty, No Guaranty. Though all description and commentary are believed to be correct, neither Auctioneer nor Consignor makes any warranties or representations of any kind with respect to the property, and in no event shall be held responsible for having made or implied any warranty of description, genuiness, authorship, attribution, provenance, period, culture, source, origin, condition, etc.

CLAIMS: No claims regarding goods purchased will be allowed. Bidders are reminded that all goods are sold on an ‘as is, where is’ basis, with all faults.

PERSONAL & PROPERTY RISKS: We will not be liable for damage or injury to individuals or their property.

ADDITIONS & DELETIONS: We reserve the right to remove and/or add lots and/or items to the sale at any point during the auction.

BUYERS: The BUYER expressly agrees to indemnify and save McKenzie’s Associated Auctioneers, the Seller and their assigns harmless from and against all claims, losses, expenses, damage or liability, directly or indirectly caused by or resulting from an act, including the negligent acts or omissions of McKenzie’s Associated Auctioneers, or anyone acting in his/her behalf in connection with or arising out of auction. All bidders/buyers must be of legal age.

AUCTION RECORDS: In the unlikely event of a dispute, you agree to accept as true the information that we have in our records.

SOFT CLOSE: Items close at regular intervals. To prevent a bidder from ‘sniping’, all bids made in the last minute of the auction will force an item to stay open for an additional 2 minutes. This will continue until all bidding has ceased.

STRATEGY: We recommend that ALL BIDDERS put in their maximum bid when placing a bid online. This does not mean you will have to pay the amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment.

CATALOGUE ERRORS & OMISSIONS: If a description does not match a picture in a lot, the description takes precedence. All items are sold on an ‘as is, where is’ basis, with all faults.
