Absentee Bid: Allows a bidder who is unable to attend the live auction to bid on a vehicle before the live auction, If your max bid is not met on the online portion of the auction the auctioneer will continue to bid on your behalf up to your maximum bid. If the bid at the live auction is higher than the absentee bid, the live auction bidder will have the winning bid.

Your credit card will be charged a $300 deposit at the fall of the hammer. The balance is due by 4:00 pm Thursday, the day after sale by Certified Funds (Cash, Certified Cheque, Bank Draft, Money Order). In addition to the standard fees a 10% Buyers Premium will be added to the cost of your purchase. There are times where a Regular Buyers Premium will be charged instead of a 10% Buyers Premium. Each lot will state where a 10% Buyers Premium or a Regular Buyers Premium will be charged. If paying in full by credit card (Visa or Mastercard), a 3% non cash payment will be charged for the full amount owing.

HST (13%) sales tax will be added to the purchase price of each vehicle after the 10% buyers premium.

All Vehicles are sold “As Is, Where Is” unless otherwise stated. Some vehicles are subject to bank and / or sell approval.

For bids for sellers approval, “IF BID” If the bid has been accepted, vehicle has been sold to you.

8. Time of payment – All bills must be paid in full before leaving the premises on the day of sale.
9. Prior to removal of purchases, payment must be made in cash, or by other means as announced by the auctioneer before the sale. Unless exempt by law, the purchaser shall pay any and all applicable taxes.
10. Upon the fall of the auctioneer’s hammer, and/or when the Auctioneer says “sold”, title on the property shall pass to the highest bidder, who thereupon assumes full risk and responsibility. All property shall be removed from the premises by the purchaser at his own risk anil expense within the time period announced by the auctioneer and if not so removed, may be sent by Auctioneer to a storage facility, for the account, risk, and expense of the purchaser.
11. Auctioneer shall, as a courtesy, undertake to make execution bills for responsible parties in their absence, yet reserves the right to decline to do so, and in no case shall be responsible for failure to do so. Please leave payment in amount of bid with accompanying name and address. The difference between the sale price and the bill, or the whole payment, if the bid fails will be returned at once. Removal of merchandise shall be in accordance with other conditions listed herein.

If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to Auctioneer and the Consignor by law, including, without limitation, the right to hold the purchaser liable for the bid price, the Auctioneer, at his option, may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) re-sell the property publicly or privately, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs, including storage, the expenses of both sales, Auctioneer commission at its regular rate and all other charges due hereunder, and incidental damages.
15. Removal – Removal shall be at the expense, liability, and risk of the purchaser. Purchases will he delivered only on the presentation of a paid bill. Auctioneer shall not be responsible for goods not removed within the time specified, and shall have the option of removing and storing at the expense and risk of the purchaser any article purchased, but not paid for and removed within the specified time. Non-delivery responsibility – Auctioneer shall not in any event, be liable for non-delivery or for any other matter or thing, to any purchaser of any lot, other than for the return to the purchaser or the deposit or sum paid on said lot, should the purchaser be entitled to it.

Greater Toronto Auctions (GTABid.com) is acting as an auctioneer-agent for many large and small companies and people just like yourself that are seeking to sell items they no longer need. Greater Toronto Auctions (GTABid.com) is not responsible for the actions of its consignors and/or their principals.

Greater Toronto Auctions (GTABid.com) in its sole discretion may ban from further use any buyer or seller which Greater Toronto Auctions (GTABid.com) believes to have in any way misrepresented itself or any items selling, failing to abide by terms, or conduct any improper auction behavior determined solely by Greater Toronto Auctions (GTABid.com).

Any seller who misrepresents their items and any buyer who fails to carry through with a purchase will be banned from any further use and may be subject to additional legal actions.

The balance will be due within three calendar days by PayPal or at pick up payable by a cashiers check/money order or cash.

PICKUPS & REMOVALS:

Dates and times for pickup will be posted on our website. Do not bid if you are unable to have your items picked up. Any item not picked up during the posted pickup times will be considered an abandoned item.

All purchases must be removed from the auction site without damaging any property and within the time announced or posted. All costs, responsibility and risk of such removal shall be done by buyer and, in every case; buyer will use prudence and care in such removal. If for any reason buyer fails to remove any of buyers purchases within the time specified, the auction company shall have the right but not the obligation, in its sole discretion, to remove and store such purchase at buyers sole risk and expense.

All items are sold in place. Buyers are responsible to remove items in a good workmanlike manner. Any plumbing must be shut off before being disconnected and any electrical that is disconnected must be capped. You must be bring any and all tools, equipment and labour required to disconnect and remove any items you purchase. We will only have security staff onsite that will not assist in any way with removal. Please plan ahead and come prepared, bringing the person-power and tools you may need. Any items not removed by the times shown will be deemed abanonded regardless of the price.

Unclaimed items, whether paid for or not, will be deemed to be abandoned at the close of the last pick-up date, unless the buyer has made previous arrangements with the auctioneer. A fee for special pick-up times outside of the posted pick-up time(s) will be added to the buyer’s invoice. After this time, abandoned items may be disposed of or re-sold at auction at the sole discretion of Greater Toronto Auctions. NO REFUND WILL BE PROVIDED FOR ABANDONED ITEMS AND PAYMENT MUST BE MADE FORTHWITH.

ABANDONED ITEMS – FEES:
Failure to pick up items at the posted times will result in your items being deemed abandoned. A $10 per item storage fee and a $25 per item moving charge will apply – large furniture items could incur additional moving fees to cover staffing and moving costs. This will be added to your invoice.

SALES TAX:

All bidders will be subject to HST.

TERMS:

All items sell AS IS WHERE IS no warranty of any type expressed to or implied as to the merchantability or fitness for any particular purpose of any goods offered in the sale. All sales are made on an AS IS WHERE IS basis with all faults. All buyers are urged to physically inspect the item during any preview times available. If no preview is available – the principle of Caveat Emptor “Let the buyer beware” applies.

No bids can be withdrawn after the auction for any reason. Buyers agree that these terms as well as all other terms set forth below, can be amended or revised only in writing, signed by Greater Toronto Auctions.

Buyers also agree that any oral representations made by the auction company shall not modify these AS IS WHERE IS terms.

All information and descriptions contained in advertising the sale are believed to be correct, but no responsibility is assumed by Greater Toronto Auctions for any errors or an omission. Greater Toronto Auctions reserves the right to close early or extend an auction at any time at its discretion.

It is strongly recommended that bidders place their maximum bid early to prevent losing an item due to illness, family emergency, poor weather, Acts of God or just plain bad luck.

RESERVE: If an item is being sold with a reserve, it will be clearly marked and identified. For items sold with a ‘reserve’, you will be required to pay a minimum amount in order to win the item. AUCTION RECORDS:
In the unlikely event of a dispute, you agree to accept as true the information that we have in our records.

SOFT CLOSE:
Items close at regular intervals. To prevent a bidder from ‘sniping’, all bids made in the last minute of the auction will force an item to stay open for an additional 4 minutes. This will continue until all bidding has ceased.

CATALOGUE ERRORS & OMISSIONS:
If a description does not match a picture in a lot, the description takes precedence. All items are sold on an ‘as is, where is’ basis, with all faults. In the event an item was listed in error or an item can’t be located during pick up for any reason, the bidder agrees that their maximum recourse is a full refund of the item in question and that all other items bid on remain binding. All Vehicles are Subject to Seller Approval. Winning Bidders will be notified by phone or email on Monday December 29 by Noon.

There is a buyers premium on each vehicle, the buyers premium is listed in the details of each vehicle, either 10% Buyers Fee (min $125) or Regular Buyers Fee as follows:

$1.00 – $399.99 = $160
$400 – $999.99 = $185
$1000 – $1999.99 = $240
$2000 – $2999.99 = $295
$3000 – $3999.99 = $320
$4000 – $4999.99 = $340
$5000 – $5999.99 = $370
$6000 – And up = $440

Winning Bidder is required to pay a deposit of $300 by Cash, Debit, Visa or Mastercard if bid approved. Balance must be paid by Cash or Certified Cheque.

Absentee Bid: Allows a bidder who is unable to attend the live auction to bid on a vehicle before the live auction, If your max bid is not met on the online portion of the auction the auctioneer will continue to bid on your behalf up to your maximum bid. If the bid at the live auction is higher than the absentee bid, the live auction bidder will have the winning bid.

Your credit card will be charged a $300 deposit at the fall of the hammer. The balance is due by 12:00 pm Wednesday (December 24th), the day after sale by Certified Funds (Cash, Certified Cheque, Bank Draft, Money Order). In addition to the standard fees a 10% Buyers Premium will be added to the cost of your purchase. There are times where a Regular Buyers Premium will be charged instead of a 10% Buyers Premium. Each lot will state where a 10% Buyers Premium or a Regular Buyers Premium will be charged. If paying in full by credit card (Visa or Mastercard), a 3% non cash payment will be charged for the full amount owing.

HST (13%) sales tax will be added to the purchase price of each vehicle after the 10% buyers premium.

All Vehicles are sold “As Is, Where Is” unless otherwise stated. Some vehicles are subject to bank and / or sell approval.

For bids for sellers approval, “IF BID” If the bid has been accepted, vehicle has been sold to you.

All deposits are non-refundable.

The winning bidder is responsible for arranging shipping and removal of the vehicle. You may pick up your vehicle at our London Ontario office.

Vehicles must be removed by 5:00 pm, 3 business days following the auction. Removal shall be at the expense, liability, and risk of the purchaser.

6. To maintain the continuity of the sale, it shall be the duty of the auctioneer to advance the bidding at his own discretion, and may reject a normal or fractional advance, should it, in his estimation, prove injurious to the sale.
7. In the case upon which there may be a reserve price, the auctioneer shall have the right to bid on behalf of Consignor, or Consignor may wish to bid personally, or by Agent However, in all cases, full commissions are due and payable to Auctioneer without distinction or preference shown to such Consignor or Agent should he become the successful bidder.
8. Time of payment – All bills must be paid in full before leaving the premises on the day of sale.
9. Prior to removal of purchases, payment must be made in cash, or by other means as announced by the auctioneer before the sale. Unless exempt by law, the purchaser shall pay any and all applicable taxes.
10. Upon the fall of the auctioneer’s hammer, and/or when the Auctioneer says “sold”, title on the property shall pass to the highest bidder, who thereupon assumes full risk and responsibility. All property shall be removed from the premises by the purchaser at his own risk anil expense within the time period announced by the auctioneer and if not so removed, may be sent by Auctioneer to a storage facility, for the account, risk, and expense of the purchaser.
11. Auctioneer shall, as a courtesy, undertake to make execution bills for responsible parties in their absence, yet reserves the right to decline to do so, and in no case shall be responsible for failure to do so. Please leave payment in amount of bid with accompanying name and address. The difference between the sale price and the bill, or the whole payment, if the bid fails will be returned at once. Removal of merchandise shall be in accordance with other conditions listed herein.
12. Auctioneer reserves the right to withdraw any item before or during the sale.
13. Neither Auctioneer nor Consignor shall be liable for any personal injury on the premises where sale shall be held.
14. If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to Auctioneer and the Consignor by law, including, without limitation, the right to hold the purchaser liable for the bid price, the Auctioneer, at his option, may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) re-sell the property publicly or privately, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs, including storage, the expenses of both sales, Auctioneer commission at its regular rate and all other charges due hereunder, and incidental damages.
15. Removal – Removal shall be at the expense, liability, and risk of the purchaser. Purchases will he delivered only on the presentation of a paid bill. Auctioneer shall not be responsible for goods not removed within the time specified, and shall have the option of removing and storing at the expense and risk of the purchaser any article purchased, but not paid for and removed within the specified time. Non-delivery responsibility – Auctioneer shall not in any event, be liable for non-delivery or for any other matter or thing, to any purchaser of any lot, other than for the return to the purchaser or the deposit or sum paid on said lot, should the purchaser be entitled to it.
16. Claims – No claims will be allowed after goods are removed from the premises.
17. All verbal announcements take precedence at time of sale.

On-Line Auction Terms & Conditions

Upon registration, the Bidder warrants that they are of legal age and have read and understand the terms and conditions as listed and that such terms shall govern this auction sale.

1. All Bidders must first complete the New Bidder Information form as provided. All Bidders are required to provide valid credit card information in order to register for this auction. YOUR CREDIT CARD WILL NOT BE CHARGED UNLESS YOU ARE THE SUCCESSFUL BIDDER.

2. Throughout the auction process Bidders are encouraged to check their bids often in order to ensure success. Bidders may also choose to receive e-mail notifications when Outbid on an item. These notifications will not be sent out during the final two hours of the auction sale.

3. Bidders have the option of setting a maximum bid amount allowing the auction software system to automatically bid on their behalf to the next highest bid increment.

4. Reserve Bids: Items may be offered for auction with a minimum opening bid requirement.

5. Soft Close: In the event that a bid is placed on an item in the final minute of the auction sale, the auction for that item will automatically be extended and remain open for an additional 3 minutes. This will continue until all bidding has ceased.

6. Although the Auction makes every attempt to ensure that all items are authentic and that all photographs and descriptions are accurate and error free, no sale shall be invalidated by reason of any defect or inaccuracy in the description or photo provided. Photos used in the Auction catalogue on occasion may be that of duplicate lots or of equal or similar items as seen and found on the internet. Preview times are offered and all Bidders are encouraged to take advantage of the Preview times in order to thoroughly inspect all items to their own satisfaction. ALL ITEMS ARE SOLD AS IS, WHERE IS.

7. The highest Bidder shall become the Purchaser and no Bidder shall retract his / her bid at any point throughout the auction sale. Upon award of the successful bid, the Purchaser will receive an invoice via email within 6 hours of the auction close. Full payment for all purchases is required on the day of the auction sale and will be charged to the credit card provided. H.S.T. plus a 10% buyer’s premium will be added to the purchase price of all items sold at the auction. Failure to provide full payment using the credit card provided or to arrange alternative method of payment during allotted pick up times may result is suspension of bidding privileges.

8. Pickup and Removal: All items must be removed on the dates and times as provided. Items not picked up after 30 days will be considered abandoned and the Auction will dispose of or resell the items at the Purchasers sole risk with no refund provided.

9. Purchasers are responsible to bring any necessary tools, packing material or additional labour in order to remove purchased items. Note: Any damages caused to the property by the Purchaser or agents acting on behalf of the Purchaser during removal of the items, will be billed to the Purchaser and added to the Purchaser’s credit card.

10. The catalogue listing may be subject to deletions at any time throughout the auction process. In the event that the Auction is unable to deliver any awarded lot(s) as a result of theft, damage, or for any reason whatsoever, the Auction’s sole liability shall be the return of any monies paid on such lots.

11. By his/her purchase, the buyer waives any claims for liability against either the Auction, its related organizations or the consignor of the item or service, arising in any way whatsoever including, but not limiting the generality of the foregoing, any liability resulting from the utilization of the property or services sold or from failure of the goods to match the provided descriptions.

We have a few rules that we all must follow to ensure that everyone has a safe and enjoyable auction experience. Greater Toronto Auctions (GTABid.com) is acting as an auctioneer-agent for many large and small companies and people just like yourself that are seeking to sell items they no longer need. Greater Toronto Auctions (GTABid.com) is not responsible for the actions of its consignors and/or their principals.

Greater Toronto Auctions (GTABid.com) in its sole discretion may ban from further use any buyer or seller which Greater Toronto Auctions (GTABid.com) believes to have in any way misrepresented itself or any items selling, failing to abide by terms, or conduct any improper auction behavior determined solely by Greater Toronto Auctions (GTABid.com).

Any seller who misrepresents their items and any buyer who fails to carry through with a purchase will be banned from any further use and may be subject to additional legal actions.

The balance will be due within three calendar days by PayPal or at pick up payable by a cashiers check/money order or cash.

If in doubt the purchase price is the Sum of the bid price, the buyers premium if applicable, the buyers fee if applicable, and all sales taxes as applicable. All payments must be in Canadian funds.

Notice: A buyers premium varies and will be clearly posted on the auction page.

PICKUPS & REMOVALS:

Dates and times for pickup will be posted on our website. Do not bid if you are unable to have your items picked up. Any item not picked up during the posted pickup times will be considered an abandoned item.

All purchases must be removed from the auction site without damaging any property and within the time announced or posted. All costs, responsibility and risk of such removal shall be done by buyer and, in every case; buyer will use prudence and care in such removal. If for any reason buyer fails to remove any of buyers purchases within the time specified, the auction company shall have the right but not the obligation, in its sole discretion, to remove and store such purchase at buyers sole risk and expense.

All items are sold in place. Buyers are responsible to remove items in a good workmanlike manner. Any plumbing must be shut off before being disconnected and any electrical that is disconnected must be capped. You must be bring any and all tools, equipment and labour required to disconnect and remove any items you purchase. We will only have security staff onsite that will not assist in any way with removal. Please plan ahead and come prepared, bringing the person-power and tools you may need. Any items not removed by the times shown will be deemed abanonded regardless of the price.

Unclaimed items, whether paid for or not, will be deemed to be abandoned at the close of the last pick-up date, unless the buyer has made previous arrangements with the auctioneer. A fee for special pick-up times outside of the posted pick-up time(s) will be added to the buyer’s invoice. After this time, abandoned items may be disposed of or re-sold at auction at the sole discretion of Greater Toronto Auctions. NO REFUND WILL BE PROVIDED FOR ABANDONED ITEMS AND PAYMENT MUST BE MADE FORTHWITH.

ABANDONED ITEMS – FEES:
Failure to pick up items at the posted times will result in your items being deemed abandoned. A $10 per item storage fee and a $25 per item moving charge will apply – large furniture items could incur additional moving fees to cover staffing and moving costs. This will be added to your invoice.

SALES TAX:

All bidders will be subject to HST.

TERMS:

All items sell AS IS WHERE IS no warranty of any type expressed to or implied as to the merchantability or fitness for any particular purpose of any goods offered in the sale. All sales are made on an AS IS WHERE IS basis with all faults. All buyers are urged to physically inspect the item during any preview times available. If no preview is available – the principle of Caveat Emptor “Let the buyer beware” applies.

No bids can be withdrawn after the auction for any reason. Buyers agree that these terms as well as all other terms set forth below, can be amended or revised only in writing, signed by Greater Toronto Auctions.

Buyers also agree that any oral representations made by the auction company shall not modify these AS IS WHERE IS terms.

All information and descriptions contained in advertising the sale are believed to be correct, but no responsibility is assumed by Greater Toronto Auctions for any errors or an omission. Greater Toronto Auctions reserves the right to close early or extend an auction at any time at its discretion.

It is strongly recommended that bidders place their maximum bid early to prevent losing an item due to illness, family emergency, poor weather, Acts of God or just plain bad luck.

All times are Eastern time (Toronto, Ontario).

RESERVE: If an item is being sold with a reserve, it will be clearly marked and identified. For items sold with a ‘reserve’, you will be required to pay a minimum amount in order to win the item. In the case upon which there may be a reserve price, the auctioneer shall have the right to bid on behalf of Consignor, or Consignor may wish to bid personally, or by Agent However, in all cases, full commissions are due and payable to Auctioneer without distinction or preference shown to such Consignor or Agent should he become the successful bidder.
8. Time of payment – All bills must be paid in full before leaving the premises on the day of sale.
9. Prior to removal of purchases, payment must be made in cash, or by other means as announced by the auctioneer before the sale. Unless exempt by law, the purchaser shall pay any and all applicable taxes.
10. Upon the fall of the auctioneer’s hammer, and/or when the Auctioneer says “sold”, title on the property shall pass to the highest bidder, who thereupon assumes full risk and responsibility. All property shall be removed from the premises by the purchaser at his own risk anil expense within the time period announced by the auctioneer and if not so removed, may be sent by Auctioneer to a storage facility, for the account, risk, and expense of the purchaser.
11. Auctioneer shall, as a courtesy, undertake to make execution bills for responsible parties in their absence, yet reserves the right to decline to do so, and in no case shall be responsible for failure to do so. Please leave payment in amount of bid with accompanying name and address. The difference between the sale price and the bill, or the whole payment, if the bid fails will be returned at once. Removal of merchandise shall be in accordance with other conditions listed herein.
12. Auctioneer reserves the right to withdraw any item before or during the sale.
13. Neither Auctioneer nor Consignor shall be liable for any personal injury on the premises where sale shall be held.
14. If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to Auctioneer and the Consignor by law, including, without limitation, the right to hold the purchaser liable for the bid price, the Auctioneer, at his option, may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) re-sell the property publicly or privately, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs, including storage, the expenses of both sales, Auctioneer commission at its regular rate and all other charges due hereunder, and incidental damages.
15. Removal – Removal shall be at the expense, liability, and risk of the purchaser. Purchases will he delivered only on the presentation of a paid bill. Auctioneer shall not be responsible for goods not removed within the time specified, and shall have the option of removing and storing at the expense and risk of the purchaser any article purchased, but not paid for and removed within the specified time. Non-delivery responsibility – Auctioneer shall not in any event, be liable for non-delivery or for any other matter or thing, to any purchaser of any lot, other than for the return to the purchaser or the deposit or sum paid on said lot, should the purchaser be entitled to it.
16. Claims – No claims will be allowed after goods are removed from the premises.
17. All verbal announcements take precedence at time of sale.

We have a few rules that we all must follow to ensure that everyone has a safe and enjoyable auction experience. Greater Toronto Auctions (GTABid.com) is acting as an auctioneer-agent for many large and small companies and people just like yourself that are seeking to sell items they no longer need. Greater Toronto Auctions (GTABid.com) is not responsible for the actions of its consignors and/or their principals.

Greater Toronto Auctions (GTABid.com) in its sole discretion may ban from further use any buyer or seller which Greater Toronto Auctions (GTABid.com) believes to have in any way misrepresented itself or any items selling, failing to abide by terms, or conduct any improper auction behavior determined solely by Greater Toronto Auctions (GTABid.com).

Any seller who misrepresents their items and any buyer who fails to carry through with a purchase will be banned from any further use and may be subject to additional legal actions.

The balance will be due within three calendar days by PayPal or at pick up payable by a cashiers check/money order or cash.

If in doubt the purchase price is the Sum of the bid price, the buyers premium if applicable, the buyers fee if applicable, and all sales taxes as applicable. All payments must be in Canadian funds.

Notice: A buyers premium varies and will be clearly posted on the auction page.

PICKUPS & REMOVALS:

Dates and times for pickup will be posted on our website. Do not bid if you are unable to have your items picked up. Any item not picked up during the posted pickup times will be considered an abandoned item.

All purchases must be removed from the auction site without damaging any property and within the time announced or posted. All costs, responsibility and risk of such removal shall be done by buyer and, in every case; buyer will use prudence and care in such removal. If for any reason buyer fails to remove any of buyers purchases within the time specified, the auction company shall have the right but not the obligation, in its sole discretion, to remove and store such purchase at buyers sole risk and expense.

All items are sold in place. Buyers are responsible to remove items in a good workmanlike manner. Any plumbing must be shut off before being disconnected and any electrical that is disconnected must be capped. You must be bring any and all tools, equipment and labour required to disconnect and remove any items you purchase. We will only have security staff onsite that will not assist in any way with removal. Please plan ahead and come prepared, bringing the person-power and tools you may need. Any items not removed by the times shown will be deemed abanonded regardless of the price.

Unclaimed items, whether paid for or not, will be deemed to be abandoned at the close of the last pick-up date, unless the buyer has made previous arrangements with the auctioneer. A fee for special pick-up times outside of the posted pick-up time(s) will be added to the buyer’s invoice. After this time, abandoned items may be disposed of or re-sold at auction at the sole discretion of Greater Toronto Auctions. NO REFUND WILL BE PROVIDED FOR ABANDONED ITEMS AND PAYMENT MUST BE MADE FORTHWITH.

ABANDONED ITEMS – FEES:
Failure to pick up items at the posted times will result in your items being deemed abandoned. A $10 per item storage fee and a $25 per item moving charge will apply – large furniture items could incur additional moving fees to cover staffing and moving costs. This will be added to your invoice.

SALES TAX:

All bidders will be subject to HST.

TERMS:

All items sell AS IS WHERE IS no warranty of any type expressed to or implied as to the merchantability or fitness for any particular purpose of any goods offered in the sale. All sales are made on an AS IS WHERE IS basis with all faults. All buyers are urged to physically inspect the item during any preview times available. If no preview is available – the principle of Caveat Emptor “Let the buyer beware” applies.

No bids can be withdrawn after the auction for any reason. Buyers agree that these terms as well as all other terms set forth below, can be amended or revised only in writing, signed by Greater Toronto Auctions.

Buyers also agree that any oral representations made by the auction company shall not modify these AS IS WHERE IS terms.

All information and descriptions contained in advertising the sale are believed to be correct, but no responsibility is assumed by Greater Toronto Auctions for any errors or an omission. Greater Toronto Auctions reserves the right to close early or extend an auction at any time at its discretion.

It is strongly recommended that bidders place their maximum bid early to prevent losing an item due to illness, family emergency, poor weather, Acts of God or just plain bad luck.

All times are Eastern time (Toronto, Ontario).

Greater Toronto Auctions reserves the right to terminate purchase if for any reason Greater Toronto Auctions is unable to complete the sale of any purchase to buyer or provide such purchase free and clear of liens, even if the buyer was given notice that he is the high bidder and purchaser, buyer agrees that Greater Toronto Auctions may terminate the purchase agreement, and which case Greater Toronto Auctions only liability shall be the return of any monies actually paid by buyer.

Buyer expressly agrees to indemnify and hold the auction company harmless against all claims , losses, expenses, damages or liability,(including, but not limited to, attorneys fees), directly or indirectly caused by or resulting from an act, including the negligent acts or omissions of the auction company, or any acting in his/her behalf in connection with or arising out of auction, except that the buyer shall not be responsible to the auction company for damages caused by or resulting from the auction companys sole negligence.

WINNING NOTIFICATION & INVOICING:
All winning bidders will receive an e-mail invoice within 24 hours of the auction closing.

ADDITIONS & DELETIONS:
We reserve the right to remove and/or add lots and/or items to the sale at any point during the auction.

RESERVE: If an item is being sold with a reserve, it will be clearly marked and identified. For items sold with a ‘reserve’, you will be required to pay a minimum amount in order to win the item. If reserve price is not met at the close of auction, the consigner will have the option to either release the reserve and sell the item to the highest bidder or keep the item.

AUCTION RECORDS:
In the unlikely event of a dispute, you agree to accept as true the information that we have in our records.

SOFT CLOSE:
Items close at regular intervals. To prevent a bidder from ‘sniping’, all bids made in the last minute of the auction will force an item to stay open for an additional 4 minutes. This will continue until all bidding has ceased.

CATALOGUE ERRORS & OMISSIONS:
If a description does not match a picture in a lot, the description takes precedence. All items are sold on an ‘as is, where is’ basis, with all faults. In the event an item was listed in error or an item can’t be located during pick up for any reason, the bidder agrees that their maximum recourse is a full refund of the item in question and that all other items bid on remain binding. By bidding you are acknowledging agreement with the terms above.Do not bid unless you agree to all of these terms.
